An executor is someone or a trust corporation you trust and appointed by you to administer your estate according to your wishes. If all the executor(s) of your first choice are unable to carry out their duties for whatsoever reason, the executor(s) of your second choice will replace the former to administer your estate without having to go to the Court for the appointment of new executor(s).

In the event you and your spouse pass on and leaving a minor (a child under the age of 18), guardian(s) appointed by you will be responsible for the welfare and upbringing of your children including education, health and living expenses. Therefore, the responsibility of a guardian is heavy and it is important for you to appoint a guardian who is able to take over such responsibility. You can appoint more than one guardian to take care of your children. If you appoint two or more guardians to take care of your children, please make sure that the guardians are able to cooperate with each other.

1. Assets: Assets include immovable properties (land, house etc) and movable properties (money, jewellery, vehicles etc) that are owned by you. However, assets held by you as a trustee shall not be treated as your own properties.

2. Distribution of Assets: You can distribute your assets according to your wishes. However, if you are married and have children, please ensure that you make reasonable provision for the maintenance of your spouse and children in your Will, otherwise your spouse and children can apply to Court and the Court may order reasonable provision for the maintenance to your spouse and children as the Court thinks fit.

3. Insurance Policy: If you have insurance policy and you have nominated your parents (provided that there is no surviving spouse or children at the moment of nomination), your spouse or children in your insurance policy, such policy is a trust policy and shall not part of the estate. Your wishes regarding your insurance policy as stated in your Will will not affect a trust policy. However, if the nomination in your insurance policy does not amount to a trust policy, such nomination will not affect your wishes as stated in your Will.

4. EPF: If you have nominated someone in your EPF account, then the nominee is your beneficiary. It is best for you to make nomination in your EPF account.

Main beneficiaries are the testator’s first choice for a beneficiary. In the event of death, the benefits go to the main beneficiary, if still living. You can have multiple main beneficiaries in some cases. For example, you could have 2 main beneficiaries, each of whom would receive 50% of assets.

Subsidiary beneficiary are used as a backup, in the event that there are no living main beneficiaries or they cannot be found. For example, assume a testator picks his wife as the main beneficiary. She would receive all assets at his death. However, if the husband and wife both die at the same time in an auto accident, there is no living main beneficiary. As a result, assets will go to a subsidiary beneficiary, if any.
